Terms & Conditions

1.0 Definitions and Interpretation

1.1 “Attendee” shall refer to any person or entity that has purchased a ticket to participate in the Event.

1.2 “Eskmills Venue” shall refer to the event space situated in Musselburgh, Scotland, where the Event shall be held.

1.3 “Event” shall refer collectively to the Eskmills Christmas Events scheduled to take place on the dates mentioned in Section II.

1.4 “Ticket” shall refer to the document, electronic or physical, which serves as proof of purchase for entry to the Event.

2.0 Dates of the Event

2.1 The Event shall take place on the following dates: – 2nd December 2023, Saturday
– 8th December 2023, Friday
– 9th December 2023, Saturday

– 15th December 2023, Friday
– 16th December 2023, Saturday – 22nd December 2023, Friday

2.2 Separate terms and conditions shall be issued for the event scheduled for 31st December 2023 (Hogmanay).

3.0 Eligibility and Admission

3.1 Attendees must be at least eighteen (18) years of age on the date of the Event. Eskmills Venue reserves the right to require satisfactory proof of age and to deny admission to anyone failing to provide such proof.

4.0 Financial Terms

4.1 The financial obligations for the Attendees are as follows:

Deposit (non-refundable) £30 £30 4.2 Attendees may elect to pay the total Ticket Price upfront.

4.3 Cancellations made prior to the 1st of September 2023 will be eligible for a partial refund of the amount paid in excess of the non-refundable deposit.

4.4 Drink packages may be cancelled and refunded up to 48 hours prior to the commencement of the associated Event.

5.0 Conduct of the Event

5.1 Friday Events shall feature a DJ and include a two-course meal with additional desserts served by usherettes.

5.2 Saturday Events shall feature live music and include a three-course meal.

6.0 Cancellations and Force Majeure

6.1 Eskmills Venue reserves the right to cancel any Event for reasons including but not limited to: safety concerns, low enrolment, or unforeseen circumstances.

6.2 No liability shall attach to Eskmills Venue in the event of cancellation arising from ‘Force Majeure’. For the purposes of this Agreement, ‘Force Majeure’ shall refer to any event beyond the reasonable control of Eskmills Venue including but not limited to Acts of God, explosion, acts of public enemy, war, insurrection, terrorist acts or threats thereof, sabotage, epidemic, embargoes, strikes, or the death of a prominent member of the British Royal Family.

7.0 Amendments and Modifications

7.1 Eskmills Venue reserves the right to amend or modify these Terms and Conditions at its sole discretion. Such amendments shall be effective immediately upon notification to the Attendee.

8.0 Promotions, Competitions, and Incentives

8.1 Eskmills Venue may at its sole discretion offer promotions, competitions, or incentives in connection with the Event. Such offerings shall be governed by their specific terms and conditions.

9.0 Limitation of Liability

9.1 Eskmills Venue shall not be liable for any indirect, consequential, exemplary, incidental, special or punitive damages, including lost profits, even if Eskmills Venue has been advised of the possibility of such damages.

10.0 Governing Law and Jurisdiction

10.1 This Agreement shall be governed by and construed in accordance with Scots Law. The parties irrevocably submit to the exclusive jurisdiction of the Scottish courts.

11.0 Miscellaneous

11.1 This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof.

11.2 If any provision of this Agreement is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that this Agreement shall otherwise remain in full force and effect.

11.3 This Agreement is not assignable, transferable, or sublicensable by the Attendee except with Eskmills Venue’s prior written consent.
